Dan Benjamin serves as counsel in federal and state court receiverships. A lawyer with extensive experience in complex civil litigation, he leads efforts to investigate claims and identify targets. He has recovered millions of dollars in receivership assets through the strategic and judicious use of contempt and asset turnover motions, “claw back” and other fraudulent transfer claims, and suits against professionals. Always careful to preserve receivership estates and contain risk, Mr. Benjamin employs a balanced approach to litigation, frequently securing assets through negotiations both before and during litigation. Mr. Benjamin is equally familiar with recovering foreign assets, and coordinating with overseas counsel to trace, seize, and repatriate assets. Lastly, Mr. Benjamin handles negotiations and litigation in contentious creditor situations, and has been repeatedly successful in securing favorable resolutions that protect receivership estates.
